2. Application of these Terms
These Terms apply to all contracts for goods and services between Cyberage NZ and any person or business who purchases goods or services from us, whether online, by email, by phone or in person. Where you are a consumer, certain statutory rights cannot be excluded (see section 7).
3. Services, orders & contract formation
• All orders are subject to acceptance by Cyberage NZ. We will confirm acceptance by sending an order confirmation by email — a binding contract is formed on our acceptance.
• We reserve the right to refuse or cancel orders for lawful reasons (stock, pricing error, ability to supply). We will notify you and refund any sums paid where an order is cancelled.
4. Price, GST and payment

• Risk passes to you on delivery; ownership passes once we receive full payment.
6. Returns, refunds & remedies (Consumers)
If you are a consumer (goods or services purchased mainly for personal, domestic or household use) you have rights under the Consumer Guarantees Act (CGA). Where a product or service fails to meet the guarantees in that Act you may be entitled to a repair, replacement or refund depending on the circumstances. We collect and handle personal information in accordance with the Privacy Act 2020. We only collect information necessary to provide our services (e.g., contact, billing and delivery details). 9. Electronic communications & signatures
You consent to receiving communications (order confirmations, invoices, notices) electronically. Electronic signatures and electronic records are acceptable and have legal effect where permitted by law under New Zealand’s electronic transactions rules. 11. Limitation of liability
To the maximum extent permitted by law, Cyberage NZ’s liability for any claim arising out of or in connection with goods or services supplied is limited to the amount paid by you for the relevant goods or services. Nothing in these Terms excludes liability that cannot be excluded by law (including certain obligations under the Consumer Guarantees Act or liability for death or personal injury caused by our negligence).
12. Force majeure
We are not liable for delays or failures arising from events outside our control (natural disaster, strikes, internet outages, courier failures). Where a force majeure event occurs we may suspend performance and will notify you as soon as practicable.
13. Termination & suspension
We may suspend or terminate access to our services for breach of these Terms or unlawful use. Termination does not affect accrued rights or obligations.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on our website and the “Last updated” date will change. Continued use after changes means you accept the updated Terms.
15. Dispute resolution & governing law
These Terms are governed by the laws of New Zealand. If a dispute arises we will try to resolve it amicably — if that fails, either party may bring proceedings in the New Zealand courts.
